I'm thinking it's because you have the mc-heading-level set to 0. That's kind of like inline formatting -- it overrides what Flare would normally do because it's specifically taking it out of the scope of the generated TOC. One of my clients distributes PDF-XChange Viewer with their applications. It's from Tracker Software. (It's free, too). I use it sometimes (like when I'm documenting my client's apps!). Very nice little viewer, with lots of markup tools.

Assuming you're using a later version of Flare (Flare 4.x or 5), you should use page layouts, not master pages, to set up the pages for your PDF output. It's in those page layouts that you can create title pages, left pages, right pages, etc., and can define the headers and footers.

My guess is that you (or another author?) added an index link set to your project but then did not add any terms to it.
