How do I keep the title page, Toc list and index page out of the TOC and index lists?

Maybe you have set the start of the tilepage to a header, like H1?
You could create a new Paragraph style (p.title) to fulfil the needs at the top of this page. In my case I have an image containing variables (using Capture 3), but it is just a paragraph.
I have set the Table of Contents without any kind of setting, just the proxy: And ... the pagelayout for the TOC has the text 'Table of Contents' in the Header Frame.
You can do the same with the Index.

I use heading styles. My default <h1> tag I use for normal content pages. I have an h1 class called "noTOC" that has its mc-heading-level value set to 0. I apply that class to the "Contents" header, so it'll looks the same as the normal header in the final print, but the title "Contents" doesn't appear in the TOC itself.

I use the same approach as Lisa - I create a paragraph style that looks the same as my heading styles but set the mc-heading-level to 0.
I also have a version of the heading (and its copy) with the page break before property set to always. That way I can force page breaks as and when I need them.

Hi,
There is a lot of old code in this Robohelp imported project and I found a rouge H5 tag in there. Got rid of it and now the page does not show up in the TOC.
